What would you do to protect your child from sexual abuse?

As a mother and lawyer (specializing in representing survivors of sexual abuse against negligent institutions), I realize now more than ever how important it is to have a strong relationship with your child. It runs deeper than emotions; it develops safety.

Cultivating a strong relationship with your children fosters communication, which, in turn, makes them less susceptible to grooming by sexual predators. Grooming consists of actions taken by predators to desensitize children to future sexual abuse. The actions taken by the predator, such as showing favoritism, mentally prime the child to comply with the sexual abuse. Strength in the parent-child relationship is a significant protective factor, and that requires a healthy combination of correction and connection.

In my own findings, a notable commonality among sexual abuse survivors is that many who were abused for a prolonged period of time felt or believed that they could not confide in their parent. In many of these cases, they may not be able to fully articulate their reasoning. It’s not necessarily that the parent did anything wrong or was a “bad” parent, but for some reason, the child chose not to disclose the sexual abuse.

In situations where the child has disclosed the abuse to the parent, the common denominator is that there is a strong relationship with the parent. Of course, there is a stigma associated with sexual abuse, shame that attaches to it, and other factors which may prevent a child from disclosing abuse.

The strength of any relationship is found in its communication, and the parent-child relationship is no different. When communication is strong, the connection between parent/caretaker and child deepens. In order for this level of communication to develop, the child must feel safe.

Sexual predators take advantage of vulnerable children. Many who fall victim to sexual abuse come from the proverbial “broken home.” In other words, many who fall victim to sexual abuse either lack a relationship with their primary caregiver(s) or come from an abusive or neglectful home. Now, there are cases that fall within the exception, but the vast majority of predators intentionally seek out vulnerable children-- just like a lion attacks a gazelle left behind by its herd.

As a mother of three boys, I realize that it is sometimes difficult to connect with your children while constantly correcting them. Discipline and correction are essential to raising a child, but if correction is all the relationship is built upon, it is impossible to fully communicate-- and ultimately, connect-- with your child.

The secret, in my experience, is to connect with your children as much as possible. That way, when you correct them, it comes from a more loving place. Your child will better receive correction once you’ve already established a connection. Too much discipline without connection erodes communication between parent and child. It is essential to find a middle ground. With the right balance, the child will feel safe to disclose possible grooming or sexual abuse by a predator.

Imagine this: someone who you barely spend time with tells you something you should fix about yourself. In this case, you might receive this feedback as criticism or admonishment, and the relationship erodes. However, the reverse is also true-- if someone who you spend time with regularly, who often communicates and connects with you, tells you something you need to improve on, it seems more like loving advice. In this case, the connection deepens, and you may even feel gratitude toward the person. Children are adults who haven’t developed yet; therefore, it’s no different for them. If anything, their experiences are magnified.

Connecting with your child looks different for everyone, depending on ages, cultures, backgrounds, and other influences. Children speak a specific language, and it is important that you speak their language in order to effectively connect. For example, if your child loves to play all day (like my son did when he was three), you might spend extra intentional time playing with them. In my son’s mind, I showed him love and care by playing with him all day and providing his basic needs. By connecting with your child in the way they will best receive it, you will continue to foster a sense of security and trust.

It is vital to find the perfect balance between connection and correction with your children. The relationship you have with your child may be what protects them from becoming yet another victim of sexual abuse.

What if I tell you that pursuing a civil legal claim may allow for a measure of justice that helps survivors of sexual abuse in their healing process?

Many survivors of sexual abuse are unaware that they can sue for the damages resulting from sexual abuse. Either they have difficulty discussing the details of their experience or are too preoccupied with picking up the pieces of their lives after the trauma. Survivors of sexual abuse may also experience post-traumatic stress disorder, and feelings of guilt or shame: other obstacles to pursuing a legal claim.

Most people are aware that there is a criminal process that can be pursued against the perpetrator if you have been a victim of a crime; however, in the criminal process, the survivor of sexual assault is not a party to the case, they are essentially a witness. The parties in the criminal process are the state versus the defendant. This means, that the survivor has little to no control over the criminal process and its outcome. Also, the burden of proof is, “beyond a reasonable doubt,” which is difficult to prove when most sexual assault cases are based on testimony as evidence. With that said, not all criminal cases result in convictions. The criminal process may also be revictimizing as the survivor feels a lack of control and, at times, law enforcement and prosecutors may be insensitive to the survivor’s trauma.

In the civil process, the survivor is a party, and makes decisions regarding his or her case. This means, that the survivor is empowered through the process. The civil process allows for compensation to be awarded to the survivor. No amount of money can make a survivor of sexual abuse whole again, but it can be of assistance in getting therapeutic care, or any other needs that may arise after the abuse. Claims are usually brought against potential defendants with assets; this may include individual perpetrators or institutions that were negligent in allowing the abuse to occur, i.e. schools, daycares, cruise ships, churches, orphanages, foster care, etc. If there is no ability to collect, the process may be revictimizing and frustrating. Therefore, it is important to recognize that not all claims are worth pursuing for the survivor.

The purpose of a civil claim is for compensation, but it may also have collateral consequences. Such as, policy changes within the defendant’s institution; notice to the public of the defendant’s deficient practices that place individuals at risk of sexual abuse; exposure of predators and predatory behaviors; motivation for other survivors of sexual abuse to come forward; and changes in standards of care allowing for a safer environment.

It is essential to choose the right legal representation when pursuing your civil claim. A trauma-informed law firm that recognizes the serious effects of trauma and integrates knowledge about trauma and adversity into the legal practice, is best. Choosing the wrong firm can result in revictimization if the case is not handled correctly by the attorney.

Lawsuit Against the School Board of Palm Beach County for the Sexual Assault of a Female Student

Krisel McSweeney filed a lawsuit against the School Board of Palm Beach County for the sexual harassment and assault by a male student who had a history of previous sexual misconduct. A press conference was held on September 3, 2021.

According to the Complaint:

· On or about October 13, 2017, Jane Doe reported to Seminole Ridge Community High School Vice Principal Randy Burden that earlier in the school day, Aggressor, a student football athlete, forcefully sexually assaulted her on school property while walking to class together.

· Aggressor forcefully fondled Jane Doe’s vaginal area under her clothes, attempting to penetrate Jane Doe’s vagina, kissed Jane Doe and grabbed Jane Doe’s hand placing it on his genitals. Jane Doe did not consent to Aggressor’s sexual acts. On the contrary, Jane Doe tried to fight him off until she finally broke free and was able to seek help.

· Despite there being video surveillance of Jane Doe’s sexual assault and Aggressor admitting to the sexual assault, the School failed to protect Jane Doe and institute appropriate and reasonable disciplinary measures against the perpetrator.

· Prior to Jane Doe’s sexual assault, school officials and faculty members offered preferential treatment to male student athletes and ignored or failed to properly respond to allegations of sexual harassment or assault lodged against male student athletes at Seminole Ridge Community High School.

· Further, prior to Jane Doe’s sexual assault, the School was on notice that Aggressor engaged in sexual misconduct with other female students.

· The only action the School took after Jane Doe’s report is to suspend Aggressor from school after he sexually assaulted Jane Doe. Aggressor was purportedly suspended from school for two weeks; however, he was escorted to football practice during the two-week suspension, including on the same day of the sexual assault.

· After reporting Aggressor’s sexual assault, Jane Doe was not offered information regarding resources or provided with safety measures while on school property. Aggressor remained in her same class, thus, she continued to see Aggressor on school campus. She was also bullied and harassed by other students due to her disclosure against Aggressor. The constant stress, depression and panic attacks Jane Doe experienced while at school resulted in an increase of absences and ultimately, Jane Doe dropped out her eleventh-grade year. Jane Doe would have graduated with her peers this year, instead she is still dealing with the negative effects of Aggressor’s violent sexual assault.

The window is closing: The Child Victims Act’s lookback ends in three months; New Yorkers should come forward

New Yorkers who were sexually molested as children, then harmed again by restrictive laws that gave them precious little time to seek justice, are running out of time to file suit against their tormentors and the institutions that enabled the abuse. As champions of the landmark Child Victims Act, which lengthened statutes of limitations and created a one-year lookback window for filing civil suits that’s since been extended to cope with COVID’s closure of courts, we urge those victimized to seek justice before the deadline arrives three months from today.

The sexual abuse of a young person is unlike any other crime. When monster molesters take advantage of children, typically ones placed in their care, it sends the victim into years of shame, self-blame, post-traumatic stress and even suicidal thinking . It’s psychologically exhausting just to come to terms with the reality of what a teacher or cleric or camp counselor or family member might have done, never mind finding the fortitude to name and confront that individual, and relive the trauma they caused, in a court of law.

It was with that profound recognition of human nature that state Sen. Brad Hoylman and Assemblywoman Linda Rosenthal insisted upon not only giving people more time to seek justice going forward, but, for a clearly defined period, to go back, unearth evidence and pursue accountability for past crimes.

As has been clear from the travails of the Catholic Church, the Boy Scouts, private schools and other institutions that knowingly sheltered child abusers or looked the other way despite repeated allegations of wrongdoing, this is not only about people scarring other people; it is about institutions that made the morally repugnant choice, over many years, to put themselves and their supposed reputations before the youngsters they were duty-bound to protect.

As Aug. 14 approaches, as New York’s lookback window closes, so, we pray, does an era in history when society ignores the anguish of countless boys and girls grown into men and women. Justice delayed need not be justice denied.
